HEADLAND MARINE SERVICES
STANDARD TERMS AND CONDITIONS OF SERVICE
1. DEFINITIONS AND INTERPRETATION
- "The Company" means Headland Marine Services, its employees, technicians, and authorized subcontractors.
- "The Client" means the owner of the vessel, or the owner’s authorized agent booking the services.
- "The Vessel" means the boat, yacht, RIB, or marine craft details provided in the Service Agreement or online Booking facility.
- "Services" means the boat care, tailored maintenance plans, valeting, gardiennage, skippering, or marine engineering works agreed upon.
- "The Website" means www.headlandmarine.co.uk.
2. ACCESS TO THE VESSEL & MARINA COMPLIANCE
- 2.1 Marina Authority: The Client must ensure that Headland Marine Services is granted explicit commercial access to the marina, dock, yard, or private property where the Vessel is located.
- 2.2 Third-Party Fees: Any contractor access fees, daily gate keys, or site commissions levied by a marina authority (e.g., Conwy Marina, Deganwy Marina, Holyhead Marine) will be passed directly to the Client’s invoice at cost, unless explicitly absorbed by the Company in writing.
- 2.3 Keys & Security: The Client is responsible for providing functional keys, hatches combinations, or security fobs. Headland Marine Services will store all keys securely and use them strictly for the performance of the agreed Services.
3. SERVICES, PLANS & BOOKINGS
- 3.1 Tailored Maintenance Plans: Personalised upkeep schedules combining cleaning and routine checks are billed as recurring monthly or seasonal packages. Subscriptions are subject to a minimum term of three (3) months unless stated otherwise.
- 3.2 Priority Booking & Repair Discounts: Clients enrolled in premium Tailored Maintenance Plans receive priority booking windows and specified percentage discounts on ad-hoc or corrective repairs. These benefits are non-transferable and apply strictly to the registered Vessel.
- 3.3 Booking & Cancellations: One-off or flexible scheduling services booked via the Website require 48 hours notice for cancellation or rescheduling. Subscription cancellations require 30 days written notice sent to the Company's official contact channels.
4. RATES, INVOICING & PAYMENT TERMS
- 4.1 Pricing Baselines: One-off detailing and cosmetics are priced per foot/metre as calculated by the manufacturer's overall length specification (LOA). Engineering and general manual repairs are billed at the Company’s standard or emergency hourly rates.
- 4.2 Payment Window: Invoices for one-off works are due upon completion or within 7 days of invoice issuance. Subscriptions are billed monthly in advance and must be settled via standing order or bank transfer by the 1st of each calendar month.
- 4.3 Late Payments: Headland Marine Services reserves the right to suspend all active services, including priority booking status and emergency storm checks, if any invoice remains unpaid past 14 days.
5. DIGITAL INSPECTIONS & PDF REPORTING
- 5.1 Reporting System: To maintain total transparency for remote boat owners, Headland Marine Services will distribute all pre-work inspections, completed work updates, and maintenance check-sheets via comprehensive digital PDF reports emailed directly to the Client.
- 5.2 Limitation of Visual Reports: These reports represent a diligent visual assessment of the Vessel’s visible components (lines, fenders, exterior canvas, visible bilges, and battery status metrics) at the exact date and time of inspection. They do not constitute a full, structural Marine Survey, and Headland Marine Services cannot be held liable for hidden latent mechanical, electrical, or structural defects that occur between scheduled visits.
6. SEVERE WEATHER & ENVIRONMENTAL PRODUCTS
- 6.1 Weather Limitations: For safety and quality reasons, certain delicate cosmetic services (such as gelcoat machine compounding, teak restoration, ceramic coating, and external anti-foul painting) cannot be executed during heavy rain, high winds, or temperatures below 5°C. Headland Marine Services reserves the right to flexibly reschedule these tasks to the next available weather window without penalty.
- 6.2 Emergency Remedial Intervention: If an inspection reveals active structural failure or danger to the asset during harsh North Wales weather (e.g., a mooring line has snapped, a fender has burst, or a canopy has torn loose), the Company will attempt to contact the owner immediately. If the owner is unreachable, the Company reserves the right to execute emergency stabilization work. This labor will be billed at our standard emergency rate, and any replacement hardware used (lines, shackles, fenders) will be charged to the client at retail cost.
- 6.3 Eco-Friendly Products: Headland Marine Services prioritizes the use of specialized eco-friendly marine products to ensure high protection against regional weather while minimizing local marine-environmental impact.
7. SKIPPERING, LOGISTICS & LIABILITIES
- 7.1 Marine Insurance: The Client warrants that the Vessel is continuously covered by a valid, fully comprehensive Marine Insurance policy, including third-party liability of no less than £3,000,000.
- 7.2 Vessel Seaworthiness: Prior to any skippering, yard transit, lift-out, re-launch management, or deck cargo delivery service, the Client must certify that the hull, propulsion, steering, and vital safety gear are fully functional and seaworthy. Headland Marine Services reserves the right to refuse skippering services if an inspection reveals unsafe vessel conditions.
- 7.3 Company Liability: Headland Marine Services maintains comprehensive Marine Trade and Shipowners' Liability insurance. The Company is not liable for structural degradation, storm damage, or equipment wear and tear that is a natural result of the Vessel being exposed to marine environments or acts of God.
8. DATA PROTECTION & PRIVACY
- 8.1 Data Storage: Any personal data collected via www.headlandmarine.co.uk booking or contact forms is processed and stored securely in accordance with our Privacy Policy for the purpose of establishing contact and fulfilling service contracts. Consent can be revoked by the client at any time. [1]
9. JURISDICTION
- This Agreement shall be governed by and construed in accordance with the laws of England and Wales, and any disputes arising out of these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
